Can a school be liable for injuries caused by another student?

In some situations, yes. Schools have a legal duty to provide reasonable supervision and a safe environment for students. When a school fails in that duty and a student is injured by another student as a result, the school may be held responsible. Factors that matter include:

  • Whether staff knew or should have known about a pattern of bullying or aggressive behavior
  • Whether proper supervision was in place at the time of the incident
