What is a preservation letter and why is it important?

A preservation letter is a formal notice we send to a trucking company (and sometimes other parties) telling them that a legal claim may be coming and that they're required to preserve specific evidence. This can include:

  • Black box and electronic logging data
  • Driver qualification files and hours-of-service logs
  • Maintenance and inspection records
  • Dispatch records and cell phone use logs
  • Dashcam or surveillance footage

Without this letter, a company may argue they didn't know they needed to keep certain records, and evidence can legally disappear. A preservation letter puts them on notice and creates accountability. If evidence is destroyed after receiving one, it can actually strengthen your case, since courts don't look kindly on that kind of conduct.
