Are there exemptions to the minimum wage and overtime requirements of the FLSA?

Yes, there are exemptions to both the minimum wage and overtime requirements of the Fair Labor Standards Act (FLSA). Certain categories of employees may be exempt from one or both of these requirements based on their job duties, salary level, or industry.The most common exemptions under the FLSA include:

  • Executive exemption: Employees whose primary duty is managing the enterprise or a recognized department or subdivision, who regularly direct the work of two or more other full-time employees, and who have the authority to hire or fire other employees.
  • Administrative exemption: Employees whose primary duty involves office or non-manual work directly related to the management or general business operations of the employer or the employer's customers, and whose primary duty includes the exercise of discretion and independent judgment with respect to matters of significance.
  • Professional exemption: Employees whose primary duty involves work requiring advanced knowledge in a field of science or learning customarily acquired by a prolonged course of specialized intellectual instruction, or whose primary duty involves work that is original and creative in character in a recognized field of artistic endeavor.
