What is the Fair Labor Standards Act?

The Fair Labor Standards Act (FLSA) is a federal law enacted in 1938 that establishes minimum wage, overtime pay, recordkeeping, and child labor standards affecting full-time and part-time workers in the private sector and in federal, state, and local governments. The FLSA aims to ensure fair compensation for employees and to protect them from exploitation by setting minimum standards for wages and working conditions. It is one of the most significant pieces of labor legislation in the United States and has been instrumental in shaping the modern workplace.

Under the FLSA, covered nonexempt employees must receive at least the federal minimum wage for all hours worked and overtime pay at a rate of one and a half times their regular rate of pay for hours worked over 40 in a workweek. The law also regulates child labor, prohibiting the employment of minors in certain hazardous occupations and setting limitations on the hours and conditions of work for minors.
