The Answer
Often, yes. Federal regulations require post-accident drug and alcohol testing for commercial drivers when a crash involves a fatality, or when it results in injury with a vehicle towed or someone treated away from the scene, depending on who received a citation.
A few things worth knowing:
- Testing windows are tight. Alcohol tests are generally required within 8 hours, drug tests within 32 hours
- Missed or delayed testing can itself become an important fact in a case
- Results feed into the carrier's broader compliance record
If testing wasn't done when it should have been, that's not a dead end. It's often a sign worth investigating further.
