Deployment and Duty: A Guide to Military Exigency FMLA Leave

When Your Spouse Deploys: What FMLA Leave Covers and How to Use It

FMLA leave for spouse deployment allows eligible employees to take up to 12 weeks of job-protected, unpaid leave per year to handle qualifying needs that arise when a spouse is called to active military duty overseas.

Here's a quick overview of what you need to know:

  • Who qualifies: Employees who have worked for their employer for at least 12 months, logged at least 1,250 hours in the past year, and work at a location with 50 or more employees within 75 miles
  • How much leave: Up to 12 workweeks per 12-month period for qualifying exigency leave
  • What it covers: Short-notice deployment, military events, childcare arrangements, financial and legal matters, counseling, rest and recuperation visits, and post-deployment activities
  • Is it paid: No — FMLA leave is unpaid, but you may use accrued paid time off concurrently
  • Job protection: Yes — you have the right to return to the same or an equivalent position

When a spouse receives deployment orders, the ripple effects on family life can be immediate and overwhelming. Childcare falls apart. Financial and legal arrangements need to be made fast. School enrollments change. And through all of it, you still have a job to show up to.

The good news is that federal law gives you real protections. The Family and Medical Leave Act (FMLA) includes specific military family provisions that go well beyond illness and injury — covering the practical, day-to-day challenges that come with a spouse's deployment.

This guide breaks down exactly what those protections look like, who qualifies, and what steps to take to protect your job while supporting your family.

Understanding FMLA Leave for Spouse Deployment

Military life is full of unexpected shifts, but the law ensures you do not have to choose between keeping your job and supporting your military spouse. Under the federal Family and Medical Leave Act (FMLA), the time you take off to handle the logistical and emotional chaos of a deployment is legally protected.

As of July 2026, the Department of Labor enforces strict guidelines regarding what counts as a qualifying military event. To take FMLA leave for spouse deployment, your spouse must be on "covered active duty" or have been notified of an impending call to covered active duty.

But what exactly does that mean? The definition of covered active duty depends on which branch of the military your spouse serves in:

  • Regular Armed Forces: For active-duty members of the Regular Armed Forces, covered active duty means deployment to a foreign country (including international waters).
  • National Guard and Reserves: For members of the National Guard or Reserves, it means deployment to a foreign country under a federal call or order to active duty in support of a contingency operation under specific provisions of Title 10 of the United States Code.

It is important to emphasize the "foreign country" requirement. If your spouse is being redeployed to a different base within the United States or its territories, federal FMLA qualifying exigency leave does not apply. The deployment must take them outside the United States, its territories, or the District of Columbia.

What is Qualifying Exigency Leave?

Typically, people think of FMLA as a tool for dealing with serious medical conditions, surgeries, or the arrival of a newborn. However, military family provisions are unique because they cover non-medical needs. This is formally known as Qualifying Exigency Leave.

A "qualifying exigency" is essentially a fancy legal term for a pressing, deployment-related issue. The law recognizes that when a service member is sent overseas, their civilian spouse is left to manage the household, legal affairs, childcare, and family emotional support alone.

According to Fact Sheet #28M: Using FMLA Leave Because of a Family Member's Military Service, this leave is designed to help civilian family members manage their practical affairs. Instead of stressing about calling in sick or facing disciplinary action for missing work, you can use job-protected FMLA time to attend pre-deployment briefings, arrange alternative childcare, or sit down with a lawyer to draft a power of attorney.

Who is Eligible for FMLA Leave for Spouse Deployment?

Not every employee is automatically covered by the FMLA. To use FMLA leave for a spouse's deployment, you must meet the standard federal eligibility requirements. We often walk clients through these three simple questions to determine if they qualify:

  1. Has your employer met the threshold? Your employer must be a private-sector company with 50 or more employees within a 75-mile radius of your worksite. (Note: Public agencies, including local, state, and federal employers, as well as public and private elementary and secondary schools, are covered regardless of the number of employees).
  2. Have you worked there long enough? You must have been employed by your company for at least 12 months. These 12 months do not have to be consecutive, though there are limits if you have had a break in service of seven years or more.
  3. Have you put in the hours? You must have worked at least 1,250 hours during the 12-month period immediately preceding the start of your leave. This averages out to about 24 hours per week.

If you meet these criteria, you have a federal right to take this leave. Employers cannot deny your request simply because they are short-staffed or because they find the timing inconvenient. If you want to know more about what these protections look like in practice, you can read our detailed breakdown on What Protections Does the FMLA Provide for Employees.

Qualifying Situations for Military Exigency Leave

family planning financial matters during military deployment

If you are eligible, you are entitled to take up to 12 workweeks of unpaid, job-protected leave during any 12-month period. This 12-week bucket of time is shared with other types of standard FMLA leave (for example, if you use 4 weeks of FMLA for your own medical condition, you have 8 weeks remaining for military exigency leave).

The law breaks down qualifying exigencies into several specific categories. Let’s look at what situations actually allow you to take time off.

Short-Notice Deployment and Military Events

Military schedules are notoriously unpredictable. Sometimes, a service member receives orders to deploy with almost no notice.

  • Short-Notice Deployment: If your spouse receives a call to active duty seven calendar days or fewer before the actual date of deployment, you can take FMLA leave to handle any urgent issue arising from that short notice. This leave can be used for a period of seven calendar days starting on the date your spouse is notified.
  • Official Military Events: You can take leave to attend official military-sponsored ceremonies, family support programs, or informational briefings related to the deployment. This includes pre-deployment, during-deployment, and post-deployment events sponsored by the military, family service organizations, or the USO.

To understand the exact regulatory definitions of these events, you can review the federal code at 29 CFR 825.126 | Leave because of a qualifying exigency. | eCFR.io.

Childcare, Parental Care, and Financial Arrangements

Managing a household on one income or with one less parent is a massive logistical challenge. FMLA allows you to take leave for:

  • Childcare and School Activities: If your spouse's deployment forces you to change your existing childcare arrangements, you can take leave to find a new daycare, enroll your child in a new school, or attend urgent school meetings (such as parent-teacher conferences addressing behavioral issues caused by the deployment). You can also use leave to provide childcare on an immediate, non-routine basis when the need arises directly from the deployment.
  • Parental Care: If your spouse's parent is incapable of self-care and relies on your spouse for assistance, you can take FMLA leave to make alternative care arrangements, admit them to a care facility, or attend care-related meetings.
  • Financial and Legal Arrangements: Deployment requires serious preparation. You can use FMLA leave to act as your spouse's legal representative, sign a financial power of attorney, update insurance policies, or meet with military legal assistance officers to handle housing or tax matters.

Rest and Recuperation and Post-Deployment Activities

FMLA protections do not stop the moment your spouse boards the plane, nor do they disappear when they return.

  • Rest and Recuperation (R&R): If your spouse is granted short-term, temporary R&R leave during their deployment, you can take up to 15 calendar days of FMLA leave to spend time with them.
  • Post-Deployment Activities: You can take leave to attend official arrival ceremonies, reintegration briefings, and other military programs for up to 90 days following the termination of your spouse's active duty status. This category also covers handling funeral arrangements in the tragic event that a spouse passes away while on covered active duty.

According to the FACT SHEET: FINAL RULE TO IMPLEMENT STATUTORY AMENDMENTS TO THE FAMILY AND MEDICAL LEAVE ACT MILITARY FAMILY LEAVE PROVISIONS | U.S. Department of Labor, these provisions are designed to give families the breathing room they need during critical transition periods.

Rules, Documentation, and Requesting Leave

Taking FMLA leave is a legal process. While the law protects you, you must follow the correct procedures to ensure your employer cannot claim you walked off the job without authorization.

How to Request FMLA Leave for Spouse Deployment

To secure your leave, you need to notify your employer and provide the necessary documentation.

  1. Provide Proper Notice: If the need for leave is foreseeable (such as a scheduled deployment), you must notify your employer at least 30 days in advance. If the deployment is sudden or short-notice, you must give notice "as soon as practicable" — which generally means the same day or the next business day after you learn of the need.
  2. Submit Certification: Your employer has the right to request proof of the deployment. You will typically need to provide a copy of your spouse's active duty orders or other official military documentation showing they are deployed (or about to deploy) to a foreign country.
  3. Complete Form WH-384: The Department of Labor provides an optional form called Form WH-384 (Certification of Qualifying Exigency for Military Family Leave). This form requires you to state the facts of the exigency, the dates you need off, and contact information for any third parties you are meeting with (like a financial planner or school official).

Navigating these requests can sometimes cause friction with human resources. If you run into issues or feel your employer is making the process unnecessarily difficult, our team at Marko Law can help. You can learn more about how we protect workers' rights by visiting our page on Employment and Labor Law.

Intermittent Leave and Job Protections

One of the most valuable aspects of FMLA leave for spouse deployment is that you do not have to take all 12 weeks at once.

  • Intermittent Leave: You can take leave in small blocks of time or on a reduced schedule. For example, you might take off two hours every Tuesday morning to take your child to counseling, or take three days off in a single week to meet with a real estate attorney.
  • Job Restoration: When you return from FMLA leave, your employer is legally required to restore you to your original job or an equivalent position with the same pay, benefits, shift, and working conditions.
  • Health Benefits: Your employer must maintain your group health insurance coverage under the same terms as if you had continued working. You will still be responsible for paying your portion of the premiums, but your coverage cannot be canceled.

If your employer threatens your job, cuts your hours, or retaliates against you for requesting or taking military leave, they are violating federal law. If you suspect your rights have been compromised, read our guide on What Should an Employee Do if Their Employer Violates FMLA or PMLA Rights.

Frequently Asked Questions about Military FMLA

How does qualifying exigency leave differ from military caregiver leave?

While both fall under the FMLA's military family provisions, they serve completely different purposes, offer different amounts of time off, and have distinct eligibility rules.

FeatureQualifying Exigency LeaveMilitary Caregiver Leave
Maximum Leave AmountUp to 12 workweeks in a 12-month periodUp to 26 workweeks in a single 12-month period
Primary PurposeTo handle non-medical, practical logistics of a deploymentTo care for a covered service member or veteran with a serious injury or illness
Qualifying Family MemberSpouse, parent, son, or daughter of any ageSpouse, parent, son, daughter, or next of kin
Applicable Military BranchRegular Armed Forces, National Guard, and ReservesRegular Armed Forces, National Guard, Reserves, and certain Veterans

Under Fact Sheet #28M(a): Military Caregiver Leave for a Current Servicemember under the Family and Medical Leave Act | U.S. Department of Labor, caregiver leave is a one-time entitlement per service member, per injury. If your spouse is injured in the line of duty, you can access up to 26 weeks of leave to assist with their recovery and treatment.

How does FMLA interact with state Paid Family Leave programs?

Federal FMLA is unpaid, which can make taking time off a financial strain. However, state laws can provide additional layers of protection and, in some cases, partial wage replacement.

In Michigan, the Michigan Paid Medical Leave Act (PMLA) provides eligible employees with paid sick time that can be used for personal or family medical needs. While PMLA does not explicitly mirror the broad federal "military exigency" categories, it can be used if your family members require medical care or counseling during a deployment.

For a complete breakdown of how state and federal leave laws work together in our local area, check out our article: What Is the Michigan Paid Medical Leave Act (PMLA) and How Does It Differ From the FMLA.

What should I do if my employer denies my military FMLA leave?

If you meet the eligibility criteria and your spouse is deploying overseas on covered active duty, your employer cannot legally deny your request for qualifying exigency leave. If they do, or if they punish you for taking it, they are committing an FMLA violation.

If this happens:

  1. Document everything: Keep copies of your written leave requests, emails, text messages, and your spouse's military orders.
  2. Do not sign away your rights: If HR pressures you to sign a document agreeing to voluntary resignation or a demotion, do not sign it without legal counsel.
  3. Contact an employment lawyer: A skilled attorney can help you file a complaint with the Department of Labor's Wage and Hour Division or pursue a civil lawsuit to recover lost wages and protect your career.
