The FMLA provides eligible employees with job-protected leave for the following qualifying reasons:
- Birth and care of a newborn child: Eligible employees may take FMLA leave for the birth of a son or daughter and to bond with the newborn child within one year of birth.
- Adoption or foster care placement: Eligible employees may take FMLA leave for the placement of a child for adoption or foster care and to bond with the newly placed child within one year of placement.
- Serious health condition: Eligible employees may take FMLA leave for their own serious health condition that makes them unable to perform the essential functions of their job, or to care for a spouse, child, or parent with a serious health condition.
- Qualifying exigencies: Eligible employees with covered family members serving in the military may take FMLA leave for qualifying exigencies arising from the covered service member's active duty military service.
