To be eligible for FMLA leave, an employee must work for a covered employer and meet certain criteria established by the FMLA. Specifically, to be eligible for FMLA leave, an employee must:
- Work for a covered employer: The FMLA applies to private employers with 50 or more employees within a 75-mile radius, all public agencies (including federal, state, and local governments), and public and private elementary and secondary schools.
- Have worked for the employer for at least 12 months: The employee must have worked for the employer for at least 12 months (which need not be consecutive) and have worked at least 1,250 hours during the 12-month period immediately preceding the start of FMLA leave.
