The FMLA Marriage Penalty and Taking Leave Multiple Times

Learn how FMLA leave same employer multiple times works for married couples under the 12-week combined limit and avoid penalties.

The FMLA Marriage Penalty and Taking Leave Multiple Times

When Both Spouses Work for the Same Employer: What You Need to Know About FMLA Leave

FMLA leave at the same employer multiple times is absolutely possible — but if you and your spouse both work for the same company, there's a critical rule that could cut your combined leave in half.

Here's the quick answer:

  • Shared leave (combined 12-week limit): Birth of a child, adoption or foster care placement, bonding with a new child, and caring for a parent with a serious health condition
  • Individual leave (each spouse gets their own 12 weeks): Your own serious health condition, caring for a spouse or child, and qualifying military exigency
  • Military caregiver leave: Shared combined limit of 26 workweeks (not 12)
  • Unmarried couples: Not subject to any shared limit — each partner keeps their own full 12 weeks

This rule — sometimes called the "FMLA marriage penalty" — is buried in federal law under 29 CFR 825.201(b). Most employees never hear about it until they actually need leave.

If you're a Michigan worker already dealing with lost wages, a difficult pregnancy, or a family medical crisis, discovering this limit at the wrong moment can be devastating.

About 1 in 5 eligible employees who take FMLA leave work for an employer that also employs their spouse. Yet many of those workers have no idea their combined leave is capped for certain qualifying reasons.

This guide breaks down exactly how the shared leave rule works, when it applies, and what your rights are if your employer mishandles it.

Understanding the FMLA Marriage Penalty for Spouses

The Family and Medical Leave Act (FMLA) is a federal law designed to help workers balance their career responsibilities with critical family and medical needs. Under normal circumstances, an eligible employee is entitled to up to 12 workweeks of unpaid, job-protected leave in a 12-month period. To learn more about the baseline protections, check out our guide on What Protections Does the FMLA Provide for Employees.

However, a lesser-known provision of the law alters this math when a married couple works for the same employer. Under these specific circumstances, the employer is legally permitted to limit the spouses to a combined total of 12 workweeks of FMLA leave for certain family-focused qualifying reasons.

This is what employment attorneys and HR professionals colloquially refer to as the "FMLA marriage penalty." Ironically, the historical intent behind this rule was to protect employers from the operational strain of having two employees in the same household out on leave simultaneously. In practice, however, it places a unique burden on married couples who choose to work for the same organization.

You can find the official Department of Labor breakdown of this policy in Fact Sheet #28L: Leave under the Family and Medical Leave Act for Spouses Working for the Same Employer.

Shared Leave Limits for Married Couples

The shared 12-week limit does not apply to all FMLA leave. It is strictly limited to four specific family caregiving scenarios:

  1. The birth of a child and to bond with the newborn child.
  2. The placement of a child with the employees for adoption or foster care, and to bond with the newly placed child.
  3. The care of a parent with a serious health condition.

For example, if a husband and wife work for the same manufacturing plant in Mount Pleasant, Michigan, and they welcome a new baby, they must share a single 12-week block of bonding leave. If the mother takes 8 weeks of FMLA leave to bond with the baby, the father is only eligible for the remaining 4 weeks of bonding leave.

Similarly, if both spouses need to care for an aging parent (either the husband's parent or the wife's parent) who has a serious health condition, their combined caregiving leave for that parent is capped at 12 weeks.

Unmarried Couples and Domestic Partners

Here is where the rule takes a highly counterintuitive turn: unmarried couples are exempt from this shared limit.

If an unmarried couple lives together, works for the exact same employer, and has a baby, both partners are legally entitled to their own individual 12 workweeks of FMLA leave for child bonding. They do not have to share.

The Department of Labor (DOL) has explicitly clarified that the combined leave limit applies only to legally married spouses. This restriction does not extend to:

  • Unmarried couples living together
  • Partners in a domestic partnership
  • Civil unions (unless recognized as a legal marriage under state law)

Under the FMLA, the definition of a "spouse" includes same-sex and common-law marriages, provided they were legally entered into in a state or country that recognizes such marriages. But if the relationship does not meet the legal definition of marriage, the shared limit cannot be enforced. Consequently, unmarried co-workers actually enjoy greater individual leave rights for child bonding than married co-workers under federal law.

Rules for Taking FMLA Leave Same Employer Multiple Times

Navigating FMLA leave at the same employer multiple times requires a solid understanding of how your employer calculates their FMLA "leave year."

Under federal regulations, an employer can choose one of four methods to track the 12-month period in which your 12-week entitlement is measured:

  • The calendar year (January 1 through December 31).
  • Any fixed 12-month period (such as a fiscal year or an employee's work anniversary date).
  • The forward-measured year (a 12-month period that begins on the first day you take FMLA leave).
  • The rolling backward year (a 12-month period measured backward from the date you use any FMLA leave).

The rolling backward method is the most common tracking mechanism used by mid-to-large employers because it prevents employees from "stacking" leave (e.g., taking 12 weeks at the end of one calendar year and another 12 weeks at the beginning of the next). Under the rolling backward method, every time you take FMLA leave, your employer looks back at the preceding 12 months to see how many weeks you have left.

For a detailed look at how these tracking methods work, review the official Fact Sheet #28H: 12-month period under the Family and Medical Leave Act (FMLA). If you are wondering about taking multiple leaves for completely different medical issues in a single year, you can read more at Can You Take FMLA Twice in One Year for Different Reasons?.

FMLA Leave Same Employer Multiple Times for Shared Reasons

When married spouses take FMLA leave at the same employer multiple times for shared reasons (like bonding or parent care), tracking becomes a joint equation.

HR manager tracking employee leave

Let's look at a real-world scenario involving Mike and Carol, a married couple working for the same employer in Detroit, Michigan.

In March 2026, Carol takes 8 weeks of FMLA leave to care for her ailing mother. Because caring for a parent is a shared FMLA reason, those 8 weeks count against the couple's combined 12-week limit.

In August 2026, Mike's father falls seriously ill and requires care. Mike requests FMLA leave. Because Carol already used 8 weeks of their shared pool earlier in the year, Mike is limited to a maximum of 4 weeks of FMLA leave to care for his father, even though Mike himself has not taken a single day of leave yet.

What happens if one spouse completely exhausts the combined 12-week limit? If Carol had taken all 12 weeks of leave to care for her mother, Mike would have 0 weeks of leave available for parent care or child bonding for the remainder of that 12-month period.

FMLA Leave Same Employer Multiple Times for Non-Shared Reasons

Fortunately, the FMLA marriage penalty is not a blanket restriction. Spouses are not required to share their FMLA leave for individual medical needs. Each spouse maintains an individual, independent right to 12 weeks of leave for non-shared reasons, which include:

  • The employee's own serious health condition (including pregnancy-related complications or postpartum recovery).
  • Caring for a spouse or a child with a serious health condition.
  • A qualifying military exigency.

Let's revisit Carol and Mike. If Carol takes 6 weeks of FMLA leave for pregnancy complications before giving birth, those 6 weeks do not count toward the combined limit because pregnancy complications qualify as Carol's own serious health condition.

Once the baby is born, Carol and Mike can still split the full 12 weeks of bonding leave. Furthermore, if Carol uses 8 weeks of the shared bonding leave, she still has 4 weeks of individual leave remaining if she needs it for her own serious health condition later in the year. Mike, having used 4 weeks of the shared bonding leave, still has 8 weeks of individual leave available if he needs to care for their child during a medical emergency.

Military Caregiver Leave and State Law Variations

The rules for FMLA leave expand significantly when military service is involved. Under the FMLA, an eligible employee who is the spouse, child, parent, or next of kin of a covered servicemember with a serious injury or illness can take up to 26 workweeks of unpaid leave in a single 12-month period to care for them.

However, just like standard FMLA leave, married spouses working for the same employer face a combined limit for military caregiver leave.

How the 26-Week Military Caregiver Limit Works

If spouses work for the same employer, they are limited to a combined total of 26 workweeks of leave in a single 12-month period if the leave is taken for military caregiver reasons, or a combination of military caregiver leave and standard shared family leave (such as child bonding or parent care).

For example, if a husband takes 20 weeks of military caregiver leave to care for his injured veteran brother (as next of kin), his wife (who works for the same company) can only take up to 6 weeks of shared FMLA leave for the birth of their child during that same 12-month period.

State-Specific Expansions and CFRA Differences

Because Marko Law represents clients across Michigan and Illinois, recognize that state laws can offer significantly stronger protections than federal FMLA. When state and federal laws conflict, employers must follow the law that is most generous to the employee.

For comparison, let's look at how California’s Family Rights Act (CFRA) differs from federal FMLA. While our primary focus is on Midwestern laws, comparing federal rules to state-specific models highlights how the FMLA marriage penalty is handled across the country.

Leave ProvisionFederal FMLA RulesCalifornia CFRA Rules
Spousal Shared LimitApplies to married couples at the same employer. No shared limit for spouses; each gets their own 12 weeks.
Unmarried CouplesNo shared limit (each gets 12 weeks).Combined limit of 12 weeks applies to any two parents at the same employer, regardless of marital status.
Definition of FamilyParents, spouse, minor children.Expands to domestic partners, siblings, grandparents, grandchildren, and designated individuals.

In Michigan and Illinois, state family leave expansions often run parallel to the FMLA, but local paid sick leave ordinances and paid medical leave acts can provide additional layers of income protection. Employers in our regions must navigate these overlapping state and federal frameworks carefully.

Employer Enforcement, Employee Rights, and Retaliation

Managing FMLA leave at the same employer multiple times is administratively complex. Employers bear the burden of tracking shared and individual leave balances accurately, and they must provide clear, legally compliant notices to their employees.

How Employers Track and Enforce Combined Leave

To enforce the combined leave limit, employers must satisfy strict Department of Labor requirements:

  • Verification of Marriage: The employer must verify that the employees are legally married. They cannot apply the combined limit to unmarried partners or domestic partners.
  • Notice Requirements: When an employee requests FMLA leave, the employer must provide a Rights and Responsibilities Notice within five business days. If the employer intends to enforce the combined spousal limit, this must be clearly communicated in writing.
  • Designation Notice: Once the leave is approved, the employer must issue a Designation Notice detailing exactly how many hours or weeks are being deducted from the employee's FMLA bank.
  • Tracking Hours Worked: Both spouses must independently meet the FMLA eligibility criteria: 12 months of employment and at least 1,250 hours worked in the 12 months immediately preceding the leave.

If an employer fails to track these balances correctly or fails to provide the required written notifications, they cannot retroactively penalize the employees for exceeding their shared limit. If you believe your employer has wrongfully denied your leave request, read our analysis on Can an Employer Deny an Employee's Request for FMLA or PMLA Leave.

It is illegal for an employer to interfere with, restrain, or deny the exercise of any right provided under the FMLA.

Common violations we see include:

  • Forcing spouses to share leave for their own serious health conditions.
  • Counting pregnancy disability leave against the combined spousal bonding limit.
  • Threatening, demoting, or firing an employee for requesting or taking FMLA leave.

If your employer misapplies the shared leave rules, denies your legitimate leave request, or retaliates against you for exercising your rights, you have a legal right to seek justice. Retaliation can take many forms, from sudden negative performance reviews to termination.

To understand what constitutes unlawful behavior in the workplace, consult our detailed resources on What Counts as Workplace Retaliation in Michigan.

Frequently Asked Questions about FMLA Leave for Spouses

What happens if one spouse exhausts the combined 12-week FMLA leave?

If one spouse exhausts the entire combined 12-workweek pool for a shared reason (such as parent care), the other spouse cannot take any leave for that specific shared reason during that 12-month period.

However, both spouses still retain their individual entitlements for non-shared reasons. For example, if Carol uses all 12 weeks of the shared FMLA pool to care for her mother, Mike still has up to 12 weeks of FMLA leave available if he needs surgery, experiences a serious health crisis, or needs to care for their child.

Does the FMLA marriage penalty apply to same-sex marriages?

Yes. Following the Supreme Court's legalization of same-sex marriage, the Department of Labor updated its definition of "spouse" under the FMLA.

The rule applies equally to all legally recognized marriages, regardless of gender. If a same-sex couple is legally married and works for the same employer, they are subject to the same combined 12-week limit for child bonding and parent care as opposite-sex married couples.

Can an employer force spouses to take FMLA leave at different times?

No. An employer cannot dictate when spouses take their FMLA leave, nor can they force spouses to take their leave sequentially rather than simultaneously.

If a married couple welcomes a new child, they have a legal right to take their shared bonding leave at the exact same time, provided they do not exceed their combined 12-week limit. An employer cannot deny a leave request simply because both spouses will be out of the office at once.

Conclusion

Navigating the intersection of family, marriage, and employment law can be incredibly stressful, especially when you are trying to manage FMLA leave at the same employer multiple times. The rules are complex, tracking methods are confusing, and the "FMLA marriage penalty" can catch even the most diligent employees off guard.

If you suspect your employer has misapplied the shared leave rules, wrongfully denied your FMLA request, or retaliated against you for taking time off to care for your family, you do not have to handle it alone.
