For a long time, employers believed they could bypass anti-retaliation laws by targeting an employee's friends or family members instead of the employee who actually complained. However, a landmark, unanimous ruling by the Michigan Supreme Court shattered this loophole.
In Miller v. Corr. (decided on May 10, 2024), the court held that ELCRA’s retaliation provision, MCL 37.2701(a), explicitly provides a cause of action for third-party or associational retaliation claims.
In that case, two corrections officers were targeted and terminated by their employer because they shared a close, family-like friendship with a supervisor who had opposed discriminatory practices within the department. The court ruled that because ELCRA prohibits retaliation against "a person" (and does not strictly limit this protection to the individual who filed the initial complaint), targeting a close associate as an indirect attack is completely illegal.
