DOL Fact Sheet #17A: White Collar Overtime Exemptions and Michigan Law Explained

Learn how Fact Sheet #17A defines white-collar overtime exemptions under the FLSA and how Michigan law affects employee misclassification.

DOL Fact Sheet #17A: White Collar Overtime Exemptions and Michigan Law Explained

What Fact Sheet #17A Means for Your Overtime Pay

DOL fact sheet #17a explains when certain executive, administrative, professional, computer, and outside sales employees may be exempt from federal minimum wage and overtime rules. For most of these exemptions, your employer must meet three tests: pay you on a salary basis, pay at least the required minimum salary, and show that your actual duties fit an exemption. A job title or salary alone is not enough.

If you work more than 40 hours in a week and were wrongly classified as exempt, you may be owed overtime. Fact Sheet #17A explains federal rules; Michigan wage law may provide additional protections.

I’m Jonathan R. Marko, founder of Detroit-based Marko Law, where I represent employees in workplace disputes, including unpaid-wage claims. In this guide to fact sheet #17a, I’ll explain what the tests mean for Michigan workers; to date, Marko Law has secured over $2 billion for its clients.

Understanding DOL Fact Sheet #17A and Core Exemption Requirements

The Fair Labor Standards Act establishes baseline labor protections across the United States. Under federal law, non-exempt employees must receive overtime pay at no less than time and one-half their regular rate of pay for all hours worked over 40 in a workweek. When workers ask, "what is the Fair Labor Standards Act (FLSA)?", the core answer involves these fundamental wage and hour safeguards.

To define which executive, administrative, and professional employees fall outside these protections under Section 13(a)(1), the U.S. Department of Labor published Fact Sheet #17A: Exemption for Executive, Administrative, ... . Qualification for an exemption generally hinges on three distinct legal requirements rather than an employer's internal job description:

  1. Salary Basis Test: The employee must be paid a predetermined, fixed amount that does not fluctuate based on the quality or quantity of work performed in any given workweek.
  2. Salary Level Test: The compensation must equal or exceed the federal minimum salary threshold of $684 per week ($35,568 annually).
  3. Primary Duty Test: The employee's actual daily job responsibilities must primarily involve specific executive, administrative, professional, computer, or outside sales tasks as defined by federal regulations.

Many businesses assume that paying a fixed salary automatically eliminates overtime obligations. Understanding what is the difference between a salary and an hourly employee is critical because receiving a predetermined salary does not strip away your legal right to overtime if your daily duties fail the regulatory tests.

White-Collar Exemption Categories Outlined in Fact Sheet #17A

Federal regulations under 29 CFR Part 541 establish specific criteria for each white-collar category. An employee must satisfy every element of a category to be lawfully exempt.

Exemption CategoryMinimum Salary StandardCore Primary Duty RequirementsKey Authority or Discretion
Executive$684 per week ($35,568/yr)Managing an enterprise, department, or recognized subdivisionRegularly directs 2+ full-time staff; authority to hire or fire
Administrative$684 per week ($35,568/yr)Office or non-manual work directly related to management or business operationsCustomary exercise of discretion and independent judgment on significant matters
Learned Professional$684 per week ($35,568/yr)Advanced intellectual work requiring specialized knowledgeRequires prolonged course of specialized intellectual instruction
Creative Professional$684 per week ($35,568/yr)Work requiring invention, imagination, originality, or talentRecognized field of artistic or creative endeavor
Computer Employee$684/week or $27.63/hourSystems analysis, software engineering, programming, or designHigh-level consulting, systems design, or software modification
Outside SalesNo salary requirementMaking sales or obtaining orders away from employer's place of businessRegularly engaged away from business premises
Highly Compensated$107,432 per yearOffice or non-manual work; performs at least one exempt dutyCustomarily performs executive, administrative, or professional duties

Fact Sheet #17A also outlines the Highly Compensated Employee (HCE) standard. Under this provision, employees who perform office or non-manual work and receive total annual compensation of $107,432 or more (which must include at least $684 per week paid on a salary or fee basis) are exempt if they customarily and regularly perform at least one of the exempt duties of an executive, administrative, or professional employee.

Standard Salary Thresholds and Nondiscretionary Bonuses

Under the federal standard salary level, an exempt employee must receive at least $684 per week, which equals $35,568 per year. Employers may use nondiscretionary bonuses and incentive payments (including commissions) tied to productivity or quality metrics to satisfy up to 10 percent of this standard salary level, provided such payments are distributed at least annually.

If an employee does not earn enough through bonuses to meet the required salary amount by the end of the 52-week period, the employer has one pay period to make a catch-up payment. If the employer fails to make that payment, the worker is non-exempt for that entire measurement period and may be owed overtime for any weeks where hours exceeded 40.

For computer professionals paid on an hourly basis, the statutory minimum hourly rate is $27.63 per hour. If an hourly computer worker is paid less than this statutory rate, they remain non-exempt and are entitled to standard overtime pay.

Specific Job Duties Tests for White-Collar Exemptions

Evaluating whether a role qualifies for an exemption requires looking past the job title to analyze actual everyday duties. In employment litigation, corporate defendants often attempt to apply high-level titles to routine workers to suppress payroll costs.

Understanding the distinction between salary vs. hourly roles requires checking each specific duty test:

  • Executive Exemption: The worker's primary duty must be the management of the enterprise, or a recognized department or subdivision. The employee must customarily and regularly direct the work of two or more full-time employees (or the equivalent in part-time workers) and possess the authority to hire or fire employees, or have significant weight given to their recommendations regarding hiring, firing, advancement, or promotion.
  • Administrative Exemption: The primary duty must consist of office or non-manual work directly related to the management or general business operations of the employer or the employer's customers. Crucially, the role must include the exercise of discretion and independent judgment with respect to matters of significance, rather than merely following established manuals or clerical protocols.
  • Learned Professional Exemption: The primary duty must be the performance of work requiring advanced knowledge in a field of science or learning. This knowledge must be customarily acquired by a prolonged course of specialized intellectual instruction, such as advanced degrees in law, medicine, engineering, or accounting.
  • Creative Professional Exemption: The primary duty must involve work requiring invention, imagination, originality, or talent in a recognized field of artistic or creative endeavor, such as writers, musicians, and graphic artists performing original work.
  • Computer Employee Exemption: The employee must work as a computer systems analyst, computer programmer, software engineer, or similarly skilled computer worker. The primary duty must involve consulting with users to determine software specifications, designing and analyzing computer systems or programs, or creating operating system machine software.
  • Outside Sales Exemption: The employee's primary duty must be making sales or obtaining orders or contracts for services, and they must be regularly and customarily engaged away from the employer’s place of business.

Workers Excluded from Exemption Under Fact Sheet #17A

Federal regulations make it clear that certain worker categories can never be classified as exempt under the white-collar regulations, regardless of their pay rate:

  • Manual Laborers and Blue-Collar Workers: The Section 13(a)(1) exemptions apply exclusively to white-collar roles. Mechanics, carpenters, construction workers, electricians, plumbers, ironworkers, craftsmen, operating engineers, longshoremen, and other workers who perform work involving repetitive operations or manual labor are non-exempt. Even if these tradespeople earn substantial annual wages, they must receive mandatory overtime pay.
  • Police, Firefighters, Paramedics, and First Responders: Police officers, state troopers, municipal firefighters, paramedics, emergency medical technicians (EMTs), correctional officers, rescue workers, and hazardous materials personnel are non-exempt. Their primary duties involve public safety and front-line physical response rather than high-level enterprise management or business operations.

Consequences of Employee Misclassification Under Federal and Michigan Law

When an employer unlawfully treats a non-exempt worker as exempt, the financial and legal repercussions can be severe. Misclassification deprives employees of wages they earned through long work hours.

Workers frequently ask, "can I sue my employer for unpaid wages or overtime?" When misclassification occurs, affected employees can file formal wage claims or civil lawsuits to recover:

  • Back Overtime Wages: Full payment of all unpaid overtime hours worked over 40 hours per week during the recovery period.
  • Liquidated Damages: An additional equal amount (100% of the back wages owed) as statutory liquidated damages under the FLSA, doubling the total recovery unless the employer proves it acted in subjective good faith with reasonable grounds.
  • Attorney Fees and Litigation Costs: Mandatory payment of the worker's reasonable legal fees and court costs by the non-compliant employer.
  • Civil Penalties: Government-assessed fines for willful or repeated wage violations.

Understanding what is the statute of limitations for filing a wage and hour claim is critical to preserving your recovery. Under the FLSA, a standard wage claim must generally be filed within two years from the date the unpaid wage was due. However, if the employer's violation was willful, the statute of limitations extends to three years.

Employers are also legally obligated under federal law to maintain accurate records of hours worked, pay rates, and payroll calculations for non-exempt personnel. When companies fail to keep proper timesheets because they misclassified an employee, courts permit workers to establish their hours through credible testimony and representative evidence.

How Michigan Wage Law Interacts with Federal FLSA Exemptions

Michigan workers operate under both federal regulations and state statutory protections. The Michigan Improved Workforce Opportunity Wage Act governs state-level wage and overtime requirements.

When an employee is working more than 40 hours a week? You may be entitled to overtime under either state or federal law. In instances where state and federal laws conflict, the employer must comply with the standard that provides the greater protection or higher wage benefit to the worker.

Additionally, workplace rules regarding meal periods and shift lengths must be coordinated between jurisdictions. Reviewing Federal vs. Michigan break laws: Know the difference before you sign that timesheet helps clarify how hours worked and compensable time are tracked across Michigan work sites.

Employees covered by collective bargaining agreements (CBAs) in Detroit, Flint, Grand Rapids, and across Wayne, Oakland, and Macomb counties often have contractual overtime protections that exceed statutory floors. A union contract or state law cannot waive an employee's statutory rights under the FLSA, but it can provide stronger overtime benefits and mandatory premium pay.

Frequently Asked Questions About Fact Sheet #17A

Does a salaried job title automatically make an employee exempt under Fact Sheet #17A?

No. A job title alone never determines exempt status under the FLSA. An employer can label a worker an "Assistant Manager," "Executive Coordinator," or "Lead Specialist," but if the employee does not meet the minimum salary threshold and perform the specific primary duties required by the regulations, they remain non-exempt and are legally entitled to overtime pay.

Can nondiscretionary bonuses count toward the salary threshold under Fact Sheet #17A?

Yes, up to 10 percent of the standard salary level ($68.40 per week) can be satisfied through nondiscretionary bonuses, incentive payments, and commissions paid on an annual or more frequent basis. If the worker's base salary plus earned bonuses does not meet the $35,568 annual equivalent, the employer must make a catch-up payment within one pay period following the end of the year to maintain the exemption.

Are first responders and manual laborers eligible for FLSA overtime exemptions?

No. Police officers, firefighters, EMTs, paramedics, and blue-collar workers performing manual labor or repetitive mechanical operations are non-exempt under federal law. They are entitled to mandatory time-and-a-half overtime compensation for all hours worked over 40 in a workweek, regardless of their total compensation level.

Conclusion

Understanding DOL Fact Sheet #17A is critical for ensuring fair pay and proper workplace classification. When employers misapply salary basis rules or duty tests, workers across Michigan lose thousands of dollars in earned overtime compensation. Holding companies accountable requires thorough trial preparation, deep knowledge of federal and Michigan wage laws, and aggressive evidence collection.
