Who is Eligible for FMLA Leave?

Not every employee is automatically covered by the FMLA. To be eligible for these protections, you must meet three specific criteria:

  1. Length of Employment: You must have worked for your employer for at least 12 months (these do not have to be consecutive).
  2. Hours Worked: You must have worked at least 1,250 hours during the 12-month period immediately preceding the start of your leave.
  3. Employer Size: You must work at a location where the employer has at least 50 employees within a 75-mile radius.

What Rights Does the FMLA Protect?

Syneos Health, LLC, the plaintiff alleged a uniform corporate policy that deemed employees on FMLA leave ineligible for promotions.
  • Biased Performance Assessments: Another common corporate tactic is comparing employees who took protected leave directly against employees who worked the entire year. In Barela v. Deloitte Consulting LLP, a class action complaint alleged that the employer's performance review system systematically penalized workers who took parental or medical leave by giving them lower ratings, which cumulatively suppressed their salary increases and bonuses.
  • No-Fault Attendance Systems: Many companies use automated point systems to track attendance. If these systems fail to excuse FMLA-protected absences or prevent employees from "cleaning" their records because they took leave, the policy is illegal.

Rule 23 class actions are "opt-out" lawsuits. This means that if the court certifies the class, you are automatically included in the lawsuit (and any eventual settlement or verdict) if you meet the class definition, unless you explicitly ask to be excluded.
