The federal Family and Medical Leave Act (FMLA) was built for traditional employees. It requires you to work for a company with at least 50 employees, have 12 months on the job, and have logged at least 1,250 hours in the past year. If you work for yourself, none of those boxes get checked.
But that doesn't mean you're completely out of options.
Eleven states — plus Washington D.C. — let self-employed workers voluntarily opt in to state-run paid family and medical leave programs. These programs can pay a portion of your income if you need time off for a serious illness, a new child, or to care for a family member.
The catch? Very few self-employed workers actually enroll. Across all states with opt-in programs, only about 1.93% of eligible self-employed workers have signed up. That's roughly 142,000 people out of 7.3 million nonemployer small businesses.

Because the federal program is unpaid, its primary value is job protection—the guarantee that your position (or an equivalent one) will be waiting for you when you return. But if you are your own boss, "job protection" takes on a completely different meaning. You aren't exactly going to fire yourself for taking time off to recover from surgery, but you will suffer from a complete lack of income while you are away from your business.
If you operate as a sole proprietor, a freelancer, or an independent 1099 contractor, you do not have an "employer" in the legal sense. You are the business. Because there is no legal separation between employer and employee in a sole proprietorship, you cannot meet the statutory definition of an "eligible employee."
Furthermore, independent contractors do not count toward the employee thresholds of the clients they serve. If you are a freelance consultant doing work for a large corporation with 500 employees, you cannot claim FMLA leave through that client. Your relationship is governed by a business contract, not an employment agreement.
This lack of structural coverage means that solo business owners are completely excluded from federal FMLA protections. There is one notable exception where a business owner might actually interact with federal FMLA rules: when their business grows.
If you incorporate your business (for example, as an S-Corporation or a C-Corporation) and employ 50 or more workers within a 75-mile radius, your business becomes a covered employer under the FMLA. If you, as the owner, are also technically classified as a W-2 employee of your own corporation, you may meet the requirements for FMLA leave.

However, for the vast majority of self-employed individuals—especially those operating in Michigan and Illinois who run solo shops or small teams—this 50-employee threshold is never met. This makes federal FMLA a non-factor, leaving state-level programs as the primary alternative.
Because federal FMLA is unpaid and excludes the self-employed, several states have stepped in to build their own Paid Family and Medical Leave (PFML) systems. These programs are designed to provide partial wage replacement when you need to take time off for qualifying medical or family reasons.
Currently, 13 states and Washington D.C. have passed PFML laws. In most of these states, traditional W-2 employees are automatically enrolled and have premiums deducted from their paychecks. For the self-employed, however, participation is almost always voluntary. You must actively choose to opt in and pay premiums to receive benefits.

Despite the availability of these programs, participation rates among self-employed individuals remain incredibly low. According to data from the Center for American Progress, only about 1.93% of self-employed workers in states with active programs have opted in. Out of 7.3 million nonemployer small businesses across the country, only about 142,000 individuals have secured coverage.
Why is the opt-in rate so low? Many business owners simply do not know these programs exist. Others find the contribution costs too high or the administrative rules too confusing. Note for our local readers: If your business is based in Michigan or Illinois, neither state currently has an active, state-run paid family and medical leave program that allows self-employed individuals to opt in. While Illinois has passed various local leave ordinances and Michigan has specific sick leave rules for employers, a comprehensive, state-administered PFML program with a self-employed opt-in is not available in these states as of July 2026. Self-employed business owners in Michigan and Illinois must rely on private short-term disability insurance, business savings, or structured business continuity planning to fund their time off.
If you do operate in a state that allows you to opt in, coverage is not free. You must pay regular premiums (contributions) based on your self-employment income, usually up to a state-specified cap.
The cost of opting in varies wildly depending on where your business is registered. In some states, you only pay the "employee" portion of the premium. In others, you are responsible for both the employer and employee shares, which can make coverage very expensive.

For example, in Massachusetts, the contribution rate for self-employed individuals opting in is 0.88% of their earnings for both family and medical leave. In Connecticut, the rate is 0.5% of self-employment earnings, capped at the Social Security contribution and benefit base.
In sharp contrast, California's elective coverage program can be incredibly costly, requiring self-employed individuals to pay a much higher percentage of their net profits compared to standard W-2 employees. This high cost is a major reason why California's self-employed opt-in rate is a mere 0.22%, while states with lower, more balanced rates see slightly higher participation.
If you decide that opting into a state PFML program makes financial sense for your business, you must follow a structured application and compliance process. You cannot simply wait until you get sick and expect to sign up the next day.

The general process for opting into a state-run program involves:
One of the most critical aspects of state PFML programs is the waiting period. To prevent people from enrolling only when they anticipate an immediate need (such as a planned pregnancy or scheduled surgery), states enforce strict waiting periods and opt-in deadlines.
If you let your coverage lapse or fail to make your quarterly payments, you may lose your eligibility and have to restart the waiting period from scratch. Continuous coverage is essential to protect your benefits.
When you finally need to take leave and file a claim, the state will calculate your weekly benefit amount based on your historical self-employment income. This is typically done using your tax filings, specifically your IRS Schedule C (Net Profit from Sole Proprietorship) or Schedule SE (Self-Employment Tax).

Partial Benefits: What if you don't want to shut down your business completely? Some states allow you to claim partial benefits. If you continue to work a small percentage of your normal hours to keep your business running, your weekly benefit will be prorated. This flexibility is incredibly valuable for self-employed individuals who cannot afford to let their client relationships go cold for months at a time.
No. Federal FMLA job protection applies only to employees. If you are a 1099 independent contractor, your relationships with your clients are governed by contract law, not employment law. A client is not legally required to hold your project open, renew your contract, or pause your deliverables while you are on medical leave.

When you work for yourself, "requesting leave" is all about managing client expectations and planning ahead. While you don't have a boss to notify, you should still follow professional guidelines to protect your business reputation.

If you opt into a state PFML program and later decide to cancel your policy, you must proceed with caution. Most states require a minimum commitment (usually three years). If you cancel before this period ends, you may be billed for back-taxes or face penalties.
Additionally, if you cancel your policy and want to re-enroll later, you will likely be treated as a new applicant. This means you will have to go through the mandatory waiting periods all over again (such as New York's two-year waiting period).
