FAQs
Can deleted digital records be recovered in court?
Yes, and this comes up more than you'd think.
When litigation begins, both parties have a legal duty to preserve relevant electronically stored information. Courts and forensic experts have robust tools to recover:
- Deleted emails and calendar entries
- Altered spreadsheets or documents
- Text messages and chat logs
- Browser history and cloud-stored files
- Metadata that shows exactly when something was changed or deleted
If records were deleted after a lawsuit was filed or reasonably anticipated, the court may impose sanctions or instruct the jury to draw negative conclusions about what was destroyed.
