FLSA overtime exemptions mean certain employees may not be entitled to federal minimum wage or overtime pay. But an employer cannot make someone exempt simply by giving them a manager title or paying a salary.
Most white-collar exemptions require all three of these tests:
Under the Fair Labor Standards Act, nonexempt employees generally must receive at least the federal minimum wage and time-and-a-half for hours over 40 in a workweek. Michigan workers may have stronger protections under state or local law, so employers must follow the rule that gives employees greater protection.

Enacted in 1938, the Fair Labor Standards Act establishes a nationwide baseline for employee compensation. Under federal law, non-exempt workers who put in more than 40 hours during a single seven-day workweek are entitled to overtime pay at not less than one and one-half times their regular rate of pay. Section 13(a)(1) of the Act, codified in federal regulations at 29 C.F.R. Part 541, carves out specific exemptions from both minimum wage and overtime requirements for individuals employed in a bona fide executive, administrative, or professional capacity.
Detailed guidance provided in Fact Sheet #17A: Exemption for Executive, Administrative, Professional, Computer & Outside Sales Employees Under the Fair Labor Standards Act (FLSA) emphasizes that exemptions are narrowly construed. An employer cannot simply assign an exempt-sounding title or convert an hourly worker to a fixed paycheck to bypass overtime obligations. Meeting the standard requires rigorous adherence to federal compensation rules and daily operational realities.

The federal standard salary level stands at $684 per week, which equals $35,568 per year. While the U.S. Department of Labor published a final rule in 2024 proposing phased increases to $844 per week and eventually $1,128 per week, those planned changes were invalidated nationwide by a Texas federal court on November 15, 2024. As a result, the federal threshold reverted to the baseline established under the 2019 regulations.
Under federal rules outlined in the Small Entity Compliance Guide, employers are permitted to use nondiscretionary bonuses, commissions, and incentive payments to satisfy up to 10 percent of the standard salary level requirement. To qualify, these payments must be distributed at least annually. If an employee's total earnings fall short of the required threshold at the end of the 52-week period, the employer must issue a catch-up payment within one pay period to preserve the employee's exempt status.

The primary exemptions under 29 C.F.R. Part 541 are commonly referred to as the white-collar exemptions. Qualifying for any of these exemptions requires satisfying strict duty-based tests established by federal regulators, focusing on the employee's primary operational impact.

Under Fact Sheet #17B: Exemption for Executive Employees Under the Fair Labor Standards Act (FLSA), an executive employee's primary duty must involve the management of the enterprise or a recognized department or subdivision. The employee must customarily and regularly direct the work of two or more full-time employees (or the equivalent in part-time workers) and possess the authority to hire or fire, or provide recommendations regarding hiring, firing, advancement, or promotion that carry particular weight. Additionally, bona fide 20 percent equity business owners who are actively engaged in enterprise management qualify under the executive exemption without meeting salary level or salary basis tests.
The administrative exemption requires the performance of office or non-manual work directly related to the management or general business operations of the employer or the employer's customers. Crucially, the employee must regularly exercise discretion and independent judgment on matters of significance, distinguishing them from staff performing routine administrative or clerical tasks.
For professional workers, Fact Sheet #17D: Exemption for Professional Employees Under the Fair Labor Standards Act (FLSA) divides the classification into learned professionals and creative professionals. Learned professionals perform work requiring advanced knowledge in a field of science or learning acquired by a prolonged course of specialized intellectual instruction, such as engineers, accountants, and chemists. Creative professionals perform work requiring invention, imagination, originality, or talent in a recognized artistic field. Practicing attorneys, licensed physicians, medical residents, and academic teachers are statutory carve-outs who qualify for the professional exemption without needing to satisfy the federal salary basis or salary level tests.
The computer employee exemption applies to skilled computer systems analysts, computer programmers, software engineers, or other similarly skilled workers. Employers may pay these professionals a salary of at least $684 per week or an hourly rate of not less than $27.63 per hour. Their primary duties must involve systems analysis techniques, consulting with users, designing and testing software systems, or creating machine operating systems.
The outside sales exemption applies to employees whose primary duty is making sales or obtaining orders or contracts for services, and who are customarily and regularly engaged away from the employer’s place of business. Unlike other white-collar exemptions, outside sales employees are not subject to a minimum salary level or salary basis test.
Employees who perform office or non-manual work and receive total annual compensation of at least $107,432 qualify under the Highly Compensated Employee (HCE) exemption. To meet this standard, the compensation package must include at least $684 paid weekly on a salary or fee basis, with the remainder composed of commissions, nondiscretionary bonuses, or incentive pay. HCEs are subject to a simplified duties test, requiring only that they customarily and regularly perform at least one exempt executive, administrative, or professional duty.
Understanding overtime rules requires looking closely at who is excluded from exemptions, as well as how federal statutes interact with state employment laws in Michigan.
The FLSA white-collar exemptions do not apply to manual laborers or blue-collar workers, regardless of how much compensation they earn. Carpenters, electricians, mechanics, plumbers, ironworkers, craftsmen, operating engineers, longshoremen, and construction workers are entitled to overtime compensation whenever they work more than 40 hours in a workweek.
Similarly, the exemptions do not apply to police officers, detectives, deputy sheriffs, state troopers, highway patrol officers, correctional officers, firefighters, paramedics, EMTs, and other first responders. Regardless of rank, title, or salary level, these individuals remain legally entitled to overtime pay under federal law.
The FLSA establishes a federal floor for worker protections, not a ceiling. When state or local employment laws provide greater protections, higher minimum wage rates, or stricter overtime requirements, employers must comply with the standard that is most favorable to the worker. In Michigan, the Workforce Opportunity Wage Act governs minimum wage and overtime standards for covered employers.
While federal law is silent regarding mandatory rest or meal breaks for adult workers, state regulations govern specific workplace conditions, as detailed in our FAQ about breaks required in Michigan. Furthermore, employers cannot use employment contracts or collective bargaining agreements to waive an employee's statutory overtime rights. When an employer misclassifies a worker as exempt, the financial and legal consequences can be significant. Employers who unlawfully withhold overtime pay are generally liable for the full amount of unpaid overtime back pay, plus an equal amount in statutory liquidated damages, alongside reasonable attorney's fees and court costs.
Under the FLSA, the standard statute of limitations for recovering unpaid overtime is two years. However, if a court finds that the employer committed a willful violation—meaning the employer knew its conduct was prohibited or showed reckless disregard for wage and hour laws—the recovery window expands to three years.

No. Paying an employee a fixed salary does not automatically make them exempt from overtime pay. Salaried employees can be non-exempt if their total earnings fall below the minimum salary threshold of $684 per week or if their daily job duties do not meet all criteria of the executive, administrative, professional, computer, or outside sales tests. Salaried non-exempt employees must be paid overtime at one and one-half times their regular hourly rate for all hours worked over 40 in a workweek.
Generally, no. Under the salary basis test, an exempt employee must receive their full salary for any week in which they perform work, regardless of how many hours they log. Permissible deductions are narrow and include full-day absences for personal reasons (other than sickness or disability), full-day absences for sickness if made under a bona fide sick leave plan, or unpaid disciplinary suspensions imposed in good faith for infractions of workplace safety rules.
